BeeSocials is an online platform to enable local people to arrange and host socials events in their homes, where they can welcome guests and enjoy a social experience in a safe environment. It is designed to bring communities together, allow local people to meet and for people to extend their social network. It also helps to welcome people new to the city and even country with open arms and create a friendly society.

To achieve all this, the platform heavily relies on the people to act in a respectful and friendly manner at all times. This platform, and community can only be built on trust and the good nature of people.

THE FOLLOWING DESCRIBES THE TERMS ON WHICH BEESOCIALS OFFERS YOU ACCESS TO OUR SITE AND SERVICES.

Welcome to the Web site operated by Beesocials (hereafter referred to as “Beesocials,” “we,” “us,” or “our”). Beesocials maintains www.Beesocials.com (hereafter “the Site") and mobile apps (hereafter “the App”, “App”, “Apps”) for Android ad iOS operating systems as a service to our users and visitors (our Site, Apps and such services, collectively, our "Services"). By using this Site and the apps, you agree to comply with and be legally bound by the following terms of use ("Terms"), whether or not you become a registered user of the Services. Please review the following terms carefully. If you do not agree to these terms, you have no right to obtain information from or otherwise continue using this Site or the Apps. Failure to use our Services in accordance with the following terms of use may subject you to severe civil and criminal penalties. We reserve the right to modify these Terms or policies relating to the Services at any time, effective upon posting of an updated version of these Terms on the Site. You are responsible for regularly reviewing these Terms. By using our services, you agree that the posting of new or revised terms and conditions on the Site will constitute adequate and constructive notice to you of any and all revisions and changes. Continued use of the Service after any such changes or after explicitly accepting the new Terms upon logging into the site shall constitute your consent to such changes.

  1. USER CONDUCT

    1. Please act in a respectful and friendly manner at all times, with all individuals you interact with.

    2. Any verbal or physical abuse will not to be tolerated and may be reported to local authorities as applicable. You will also be banned from using our service.

    3. Any discrimination, including but not limited to racial or sexual will not be tolerated and may be reported to local authorities as applicable. You will also be banned from using our service.

    4. Beesocials is a venue for users to create or find events (hereafter “socials”, “social”) to attend. We are not involved in the face-to-face contact between users of our platform and have no control over the accuracy of information posted by users to our platform.

    5. We do not make any attempts to confirm the identity of the users of our Services. Users are responsible for determining the identity of others when creating socials or attending socials created through Beesocials.

    6. You are solely responsible for your interactions with other Beesocials users. We are not responsible for any harm arising out of any interactions that may be arranged through Beesocials. We reserve the right to monitor disputes however have no obligation to do so.

    7. Once a Social has been listed with a price and other users have purchased tickets, the price must not be altered.

    8. You must be over the age of 18 to use our services. By registering to use our services you confirm that you are over 18.

    9. You are responsible for any content posted on Beesocials. You must not post any content that is offensive or illegal. We remove any content we believe to be objectionable.

    10. You must report any offensive or illegal content and/or user you find on the platform.

    11. Currently our services are only offered in the United Kingdom and therefore you will use our services in consistent with UK Law, rules and regulations.

  2. USER CONTENT

    1. You Grant Us a License. By submitting any content (including without limitation, any photograph, words, pictures, or symbols) on our Apps, you hereby grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, perform, adapt, modify, sell, distribute, have distributed and promote such content in any form, in all media now known or hereinafter created and for any purpose, subject to our Privacy Policy. You represent and warrant that you have sufficient rights to grant us this license.

    2. Content Restrictions. You are solely responsible for any content that you submit, post or transmit via our Services. You may not post or submit any content that:

      1. infringes the copyright, trademark, or other intellectual property rights of any person;

      2. is defamatory;

      3. contains nudity or sexually explicit content, or is otherwise obscene;

      4. may disparage any ethnic, racial, sexual, religious, or other group by stereotypical depiction or otherwise;

      5. depicts individuals under 18 years of age;

      6. depicts or advocates the use of illicit drugs;

      7. makes use of offensive language or images;

      8. characterizes violence as acceptable, glamorous or desirable; or

      9. Provides a link to any other websites.

    3. No Obligation to Post Content. We have no obligation to post any content from you or anyone else. In addition, we may, in our sole and unfettered discretion, edit, remove or delete any content that you post or submit.

 

  1. SOCIALS

    1. Beesocials is a platform for social experiences (“Socials”) provided by “Hosts” registered on our platform. Hosts are solely responsible for providing these socials as described in their social listing and according to these terms and any guidelines published on the platform. The specific details for each Social, including number and price of tickets (“invites”) as well as description and location is provided by the Host. Host is solely responsible for the Social details and descriptions, subject to the "DISCLAIMER OF WARRANTIES" and "LIMITED LIABILITY" Sections of these Terms

  1. RESTRICTION

    1. In connection with your use of our Services, you must act responsibly and exercise good judgment. Without limiting the foregoing, you will not:

      1. Infringe the rights of any person or entity, including without limitation, their intellectual property, privacy, publicity or contractual rights

      2. interfere with or damage our Services, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology

      3. Use our Services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card or account numbers.

      4. Use our Services in connection with the distribution of unsolicited commercial email ("spam") or advertisements unrelated to hosting or attending a social on the platform

      5. "stalk" or harass any other user of our Services or collect or store any information about any other user other than for purposes of transacting as a BeeSocials guest and host with one another

      6. Register for more than one user account or register for a user account on behalf of an individual other than yourself

      7. Impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity

      8. Use automated scripts to collect information or otherwise interact with the Service or the Apps

      9. Use the site to find a host, social or guest and then complete the transaction offline in order to circumvent your obligation to pay for the Service

      10. submit any social listing with a false or misleading price, or submit any social listing with a price that you do not intend to honour

      11. Advocate, encourage, or assist any third party in doing any of the foregoing.

The foregoing is merely a list of examples of prohibited conduct. BeeSocials reserves the right to cancel a user account or take other appropriate actions in its sole discretion in response to any inappropriate conduct, or for no reason at all.

  1. DAMAGE TO VENUE

    1. We shall not be liable for damages of any kind (including but not limited to any direct or incidental damage) caused to the venue by the users of this service.

  2. DISCLAIMER OF WARRANTIES

    1. YOU ACKNOWLEDGE AND AGREE THAT THE PLATFORM IS PROVIDED FOR USE "AS IS", WITHOUT ANY WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, CONDITIONS, REPRESENTATIONS, AND GUARANTEES WITH RESPECT TO THE PLATFORM.

    2. IF YOU USE OUR SERVICES YOU DO SO AT YOUR OWN RISK. YOU AGREE THAT BEESOCIALS DOES NOT CHECK USERS AND THEIR BACKGROUNDS. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS BEESOCIALS AND ITS REPRESENTATIVES AGAINST ANY AND ALL CLAIMS AND EXPENSES, ARISING OUT OF YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO YOUR VIOLATION OF THIS AGREEMENT.

    3. WE DO NOT WARRANT THAT (A) OUR SERVICES WILL MEET YOUR REQUIREMENTS; (B) OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) ANY INFORMATION THAT YOU MAY OBTAIN THROUGH OUR SERVICES WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN ANY DATA OR SOFTWARE WILL BE CORRECTED.

    4. NO DATA, INFORMATION OR ADVICE OBTAINED BY YOU IN ORAL OR WRITTEN FORM FROM US OR THROUGH OR FROM OUR SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

  3. LIMITED LIABILITY

    1. WE SHALL NOT BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, ANY INCIDENTAL,DIRECT, GENERAL, CONSEQUENTIAL ,SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES) EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM OR RELATING TO: (A) THE USE OR INABILITY TO USE OUR SERVICES; (B) HARM OR DAMAGE TO YOUR PROPERTY AS A RESULT OF USING OUR SERVICES; (C) DISCLOSURE OF, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT; (D) ANY HARM TO YOU CAUSED IN WHOLE OR PART BY A THIRD PARTY, INCLUDING BUT NOT LIMITED TO ANOTHER USER OF THE SERVICES; (E) STATEMENTS, CONDUCT OR OMISSIONS OF ANY GUEST, HOST, OR OTHER THIRD PARTIES ON OUR SERVICES; OR (F) YOUR OR ANYONE ELSE'S CONDUCT OR ACTS IN CONNECTION WITH THE USE OF THE SERVICES, INCLUDING WITHOUT LIMITATION FROM INTERACTIONS WITH OTHER USERS OF OUR SERVICES OR PERSONS INTRODUCED TO YOU BY OUR SERVICES, WHETHER ON-LINE OR OFF-LINE.

    2. WE SHALL NOT BE LIABLE FOR ANY DELAY OR FAILURE IN PERFORMING UNDER THESE TERMS DUE TO CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF NATURE AND POWER, INTERNET, AND EMAIL DISCONTINUITY.

  4. INDEMNITY. You shall indemnify and hold us (and each of our officers, directors, and employees) harmless from any third-party claim, demand, action, damage, loss, cost or expense, including without limitation reasonable legal fees, arising out or relating to your use of our Services or alleging facts or circumstances that, if true, could constitute your breach of any of these Terms. We will control any such defense and related settlement and you will reasonably assist us therewith at your expense.

  1. TERMINATION

5.1 We may at our discretion terminate your use of our services and delete your account. Upon doing so any money owed to you from ticket sales will be paid out, less our fees and any refunds arising from disputes.

  1. PAYMENTS AND REFUNDS

    1. Payments from guests will be held by BeeSocials until the event has been completed, at which point it will be available for you to cash out (subject to a 15% platform fee).

    2. Hosts are responsible for processing refunds directly to the guests, at which point the 15% platform fee will also be refunded.

    3. Users are advised to initially make attempts at resolving any disputes, but you may escalate to BeeSocials if you are unable to reach a satisfactory resolution. At this point BeeSocials will investigate and attempt to reach a fair outcome for both parties. However, BeeSocials provides no guarantees to this effect and will not be liable for any loss incurred due to any disputes between users of the service.

    4. Taxes. You understand that we are acting solely as an intermediary for the collection of payments and fees between you and any hosts or guests with whom you choose to enter into a transaction. You are solely responsible for determining your own tax reporting requirements in consultation with tax advisors, and that we cannot and do not offer tax advice to either hosts or guests.

    5. Information storage. We do not store your financial information. All billing and ID information is processed and stored by our payment processor Stripe. Please visiting www.stripe.com for their privacy policy.

  1. INTELLECTUAL PROPERTY

    1. Our Intellectual Property. Material on our Site an Apps(with the exception of Third-Party Content) is protected by rights of publicity, copyright, trademark, trade secret, and other proprietary rights and intellectual property laws as applicable. Except as expressly authorized by us, you may not sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from such material. Our Platform’s trademarks (whether registered or not), name, logo and domain name – are our sole property. You may not use them, or any confusingly similar mark or text, without our prior express written consent.
      This section will survive the termination of the Terms.

    2. Your Use of Our Intellectual Property. You may not systematically retrieve data or other content from our Apps to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise. You may not display any portion of our app in a frame (or any content from our apps through in-line links) without our prior written consent.

  2. YOUR ACCOUNT

    1. You are required to register an account on BeeSocials in order to use our services. You may only create and hold one user account on the Platform. To sign up and login, you must provide an email and password or to use Facebook to connect. We may establish and require additional or different means of identification and authentication for logging-in and accessing the Platform.

    2. You are solely responsible for the confidentiality and use of your account details and password. You must notify us as soon as you become aware of any potential or actual misuse, unauthorized use, of your account. You agree that any person who you directly or implicitly permit to use your password is authorized to act as your agent to use the Platform, including purchases on your behalf.

    3. You may request for your account to be terminated by emailing us on info@beesocials.com. We may require you to verify your identity by sending us further information, as a condition for terminating your user account. Once we complete your request of terminating your account you will no longer be able to access the platform as a registered user.

  3. MODIFICATION OR TERMINATION OF SERVICES

    1. We may, in our discretion and without liability to you, with or without prior notice and at any time, modify or discontinue, temporarily or permanently, all or any portion of our Services.

  4. DATA PROTECTION

    1. Under the Data Protection Act 1998 ("Data Protection Act"), you have a legal right to a receive copy of all the personal information about you which is held by us. Although we make efforts to protect your information, we cannot guarantee that our systems will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.

  1. GOVERNING LAW; JURISDICTION.

    1. These Terms are governed by English law only. Any legal claim will take place within the United Kingdom (and English courts will have the exclusive jurisdiction for it). All legal proceedings will be conducted in English.
      This section will survive the termination of the Terms.

  2. FILING A COMPLAINT

    1. You may file a complaint about any content or user you find harms you in any way. You can do this by contacting us on info@beesocials.com with the word ‘Complaint’ in the subject. We will make reasonable efforts to review your complaint and respond promptly.

Your continued use of our platform and registration to use our Services is contingent upon your agreement to be bound by the foregoing Terms of Use.
